Welcome to MyMeal.nl. The website MyMeal.nl and the website and mobile application MyMeal.mobi (collectively referred to hereafter as the "Application") are an initiative of MyMeal.mobi Services B.V. (hereafter referred to as "MyMeal"). We are located at Steffensberg 45, 9431 CX Westerbrok. Our Chamber of Commerce number is 70353875.

Through the Application, you (hereafter referred to as "User" or "you") can order meals, ingredients, or other cooking products (hereafter referred to as the "Offer") from restaurants and food or cooking product sellers (hereafter referred to as "Partners"). In addition, you have the option to reserve a table at restaurant Partners. On the MyMeal.mobi website, as a logged-in User, you can also use several interactive features, such as sharing content on an account you create. Below you will find our general terms and conditions. These conditions apply to the use of our Application and ordering the Offer via the Application from one of our Partners. We advise you to read the terms and conditions carefully before using our Application. We want our Application to continue to develop with a focus on ease of use for Users. MyMeal will always take into account feedback from Users. At our FAQ, you can find an answer to the most frequently asked questions. If you have questions, comments, or complaints, or if you encounter problems with your account, you can always contact us via info@mymeal.nl or through our contact page. You will receive a response within five (5) working days.

Offer and Agreement

On the MyMeal Application, the Offer from Partners that you can order is displayed. If you place an order, you will receive a confirmation email from us, on behalf of our Partner, stating that the order has been received and whether it has been accepted. If your order is accepted, an agreement is established between you and our Partner. MyMeal only acts as an intermediary for our Partner. The agreement can only be executed by our Partner if you provide correct and complete contact information. We use your email address to inform you about the status of your order and need your address and phone number to deliver the order correctly. When delivering your order, the delivery person may ask for identification if your order contains alcoholic products or other age-limited products. If you do not meet the minimum age or cannot provide identification, the relevant products will not be delivered to you. You will not receive a refund. If no one answers at the provided address and there is no response to a phone message, the order may be canceled. You will not receive a refund.

Allergies

Orders may contain food items to which you could be allergic. If you are allergic to certain foods, please contact our Partner for current allergen information before placing an order. MyMeal cannot guarantee that every order containing food will be free of allergens.

Cancellation or Return

If you wish to cancel an order, you must contact the Partner where your order was placed. Cancellation is only possible if the Partner explicitly indicates this. MyMeal and Partners reserve the right to cancel an order at all times. In that case, you will be informed as soon as possible. In the event of a timely cancellation of the order, a previously made payment will be refunded by MyMeal or Partner. If you are not satisfied with the products you ordered, please contact the Partner where you placed your order within 14 calendar days. The following products cannot be returned: Products that spoil quickly or have a limited shelf life; Sealed products that are not suitable for return for health protection or hygiene reasons and whose seal has been broken after delivery; Products that are irreversibly mixed with other products after delivery.

Price and Payment

If an agreement has been established between you and Partner, you are obliged to pay the owed amount. All prices displayed in the MyMeal Application include VAT. Before placing an order, you will be informed of any delivery costs. Payment is made via an online payment method through the Application and is made to MyMeal. MyMeal is authorized by Partners to receive payments. Prices may vary and can be changed at any time. A price change does not affect an order you have already placed and confirmed.

Table Reservation

Through our Application, you also have the option to reserve a table at MyMeal affiliated restaurant-Partners. Through the Application, you choose a day, time, and number of people. A reservation is final when our Partner has accepted the reservation and you have received a confirmation email. A reservation is only valid on the day and time as shown in the confirmation email. Cancellation is free of charge and can only be done by contacting the Partner-restaurant directly.

Complaints

If you have a complaint about the MyMeal Application, the Offer, or your order, please contact MyMeal. You can submit your complaint via the contact form on our website or send an email to info@mymeal.nl.

Security and Availability

You can count on us to provide a user-friendly Application that is safe for everyone. We take all reasonable measures necessary to ensure the proper functioning, security, and accessibility of the Application. These measures are of both technical, non-technical, and organizational nature. However, we cannot give you absolute guarantees. The commitment we undertake in this regard is only an effort obligation. We strive to achieve the best possible response time and access for you. We reserve the right to restrict access to our Platform at any time and/or to interrupt it entirely or partially, even without prior warning. We do this in principle only if circumstances require it, but this is not an absolute condition. MyMeal is never liable to pay compensation in connection with limited access or non-use. Any use of the Application is always at your own risk. This means that we are not liable for damage resulting from malfunctions, interruptions, harmful elements, or defects in our Platform, regardless of the existence of force majeure or a foreign cause. MyMeal provides its Platform "AS IS" and "AS AVAILABLE," meaning without any explicit or implicit warranty regarding the proper functioning, accessibility, and safety.

Terms of Use of the Application

Registration

You also have the option to create an account on the Application. You can register with your own email address and a password of your choice. Information about your account (password changes, confirmation messages, etc.) is sent exclusively electronically to the email address you provided. MyMeal has complete freedom to determine the registration conditions at its discretion and to adjust them at any time. When registering and using the Application, you must enter correct, truthful, current, and complete information. Each User account is strictly individual, personal, and confidential. You are exclusively responsible for all actions performed under the User account. You are also responsible for the confidentiality of your login details and User account.

Behavioral Rules

With an account, you have access to interactive features on parts of the Application, such as sharing recipes or following other User accounts. As a User, you must refrain from actions that have or can have a harmful impact on the proper functioning and safety of the Application or other Users. The following actions are strictly prohibited: Using software programs aimed at collecting and obtaining data, including spiders, crawlers, robots, and similar software. This list is not exhaustive. Unauthorized access to the content of the Application. Using a foreign identity and/or foreign data for registration. Investigating or testing the security of MyMeal or circumventing the technologies used by MyMeal, its licensors, or other third parties to protect the content or service; Spreading insults, threatening language, texts or pictures that violate good morals, or pornographic, crude, and racist language. Infringements of intellectual property rights, including copying, redistributing, imitating, 'ripping', transferring, displaying to the public, broadcasting, or making available to the public of the service or content of the MyMeal Platform or otherwise using the MyMeal Platform or the content in a way that is not expressly permitted under these terms of use or applicable law. Spreading computer viruses that may damage the MyMeal Platform. The above list is not exhaustive. You accept that MyMeal, if there is a reasonable reason for it, can monitor your data and behavior in connection with the above misuse. We strive to investigate complaints from Users and take appropriate measures. Complaints regarding the above misuse can be reported via info@mymeal.nl or through the contact page.

Sanctions

MyMeal has the right to take all reasonable and appropriate measures if you, as a User, act contrary to these conditions and/or applicable legal rules, the rights of third parties, or the generally accepted internet behavior rules. MyMeal retains a wide margin of choice regarding the taking of a sanctioning and remedial measure and the scope of that measure. However, measures will always be proportional to the infringement. MyMeal has, among other things, the option to permanently or temporarily delete your account or content that you have uploaded to our Application. MyMeal will inform you of this, stating the reason. When circumstances require it, these measures can be taken without any prior warning or notice. As a User, you cannot claim a refund or compensation for the measures taken. If you believe that the measure taken is inappropriate or unfounded, you must report this to MyMeal within fourteen (14) calendar days after the measure has been imposed. MyMeal will consider the arguments without being obliged to undo the initial measures.

Privacy

If you use our Application, you share certain personal data with us. We attach great importance to your privacy and personal data. Therefore, we would like to inform you about our policy regarding personal data. For this purpose, we refer you to our privacy policy, which provides more information about the guarantees regarding the protection of your personal data.

Liability and Force Majeure

You use our platform at your own risk, and we are not liable for any damage you may suffer as a result of using our Application. We also accept no liability for incomplete or incorrect content on the Application. MyMeal is only liable for any heavy or repeated light contractual and/or extra-contractual failure attributable to it in the performance of its obligations under these Terms of Use. This liability is limited to the direct damage resulting from the failures and can never be higher than the price of the order you have paid. If MyMeal is completely or partially prevented from fulfilling its obligations towards you due to circumstances beyond its control, this will be considered force majeure. In that case, MyMeal is not obliged to fulfill its obligations towards you. MyMeal is entitled to suspend its obligations for the duration of the force majeure.

Intellectual Property

All intellectual property rights in respect of the Application and the content made public on it (excluding contributions from Users) remain with MyMeal or with third parties from whom we have permission to use the content. You commit not to infringe on the intellectual property rights of MyMeal or any other party in any way. If you as a User commit an infringement in terms of intellectual property rights of third parties, these can in no way be attributed to MyMeal. Any factual consequences or legal consequences are therefore entirely for your account as a User.

Third-Party Applications

The content of our Platform may contain websites or services of third parties or a link, hyperlink, or framed link to foreign websites or other forms of electronic portals (“third-party applications”). MyMeal cannot be held liable for any damage resulting from the use of third-party applications. We advise the User to carefully review the terms of use and privacy policy of these other applications.

Amendment of These Terms and Applicable Law

We have the ability to adjust our conditions from time to time. Dutch law applies to our conditions and any disputes arising from them.
